These Terms govern your use of this website and any purchase you make through it. The shop is operated by Sarah Benedikt from Guadalajara, Jalisco, Mexico.

By placing an order, you agree to these Terms. Nothing in these Terms limits any consumer rights or remedies that cannot legally be excluded or waived.

What this shop is

Digital Independence publishes a lexicon and technical guides and sells printed goods.

The written content is free to read. You don't need to create an account or provide an email address to read it.

Our physical products are made to order. We don't keep finished products in stock. Orders are sent to our fulfilment partner, Printful, which prints and ships the products on our behalf.

Orders

Where we sell

We currently ship orders to Canada, excluding Quebec. If your location is not available at checkout, we cannot accept an order for that destination yet.

Before you place an order

Each product page provides information about the product, including its description, price, materials and available sizes.

Shipping costs and applicable taxes are shown at checkout where required. Delivery estimates are provided in our Shipping Policy.

Our cancellation, return, replacement and refund rules are set out in our Return & Refund Policy. Those policies form part of these Terms.

Before you pay, checkout gives you an opportunity to review your order, see the total amount payable and correct errors.

Order acceptance

When you place an order, you are making an offer to purchase the products in your order.

We accept your order when we send you an order confirmation. Until then, we may decline an order, for example because of a pricing error, technical error, suspected fraud, product availability issue or other reasonable reason.

If we discover after accepting your order that we cannot fulfil it, we will contact you and provide a full refund for the affected order.

Your order confirmation

Your order confirmation email is your copy of the agreement for your purchase. It includes the products you ordered, the amount paid and the delivery address.

Please keep this email for your records. If you need another copy, contact us at hello@dimerch.com.

Prices and product appearance

Prices may change, but a price will not change after your order has been accepted.

Prices are displayed in the currency shown on the site or at checkout. The final amount payable is shown before you place your order.

Product photographs are mockups and are intended to show the product and design. Colours may vary between screens and between production batches.

Measurements may vary slightly from the sizing information shown on the product page.

Delivery, returns and refunds

Delivery estimates, production times and shipping information are set out in our Shipping Policy.

Returns, replacements and refunds are explained in our Return & Refund Policy.

Nothing in those policies or these Terms limits any statutory rights you may have under applicable consumer protection law, including rights relating to defective, damaged or incorrectly supplied goods.

Customs and import charges

Depending on the destination and fulfilment method, customs duties, import taxes or other charges may apply. Where such charges are not collected at checkout, they may be payable by the customer.

Accounts

You can check out as a guest.

If you create an account, keep your login credentials confidential and contact us promptly if you believe someone has accessed your account without your permission.

Intellectual property

The designs, illustrations, written content, logo and other original materials on this website are owned by Sarah Benedikt or used under appropriate licences.

Purchasing a physical product does not transfer ownership of the underlying artwork or other intellectual property. You may not reproduce, manufacture, modify for commercial use, commercially exploit or resell our designs without permission.

You may quote reasonable excerpts from the Digital Independence lexicon and guides for commentary, education or reference, provided you credit Digital Independence and link to the original page. You may not reproduce, republish or redistribute substantial portions of our content without written permission.

If you believe that material on this website infringes your rights, contact hello@dimerch.com with enough information for us to identify the material and understand your concern.

Your conduct

You must not:

attempt to gain unauthorized access to the website or its systems;
interfere with the operation or security of the website;
use automated requests in a way that materially degrades the service for other users; or
use the website to violate applicable law.

Comments on articles may be moderated. We may remove comments that are abusive, unlawful, spam, or otherwise inappropriate.

Third-party services

We use third-party services to operate the shop, including Shopify for our online store and Printful for product fulfilment.

These providers may experience outages, delays or other issues outside our reasonable control. Their services are also subject to their own terms and policies.

Our Privacy Policy explains how personal information is handled by us and the third-party services we use.

Some Digital Independence guides may contain affiliate links to hardware or other products. Where a link earns us a commission, we disclose this on the relevant page. A commission does not determine what we recommend, and we explain the reasons for our recommendations so you can make your own decision.

External links are provided because we believe they may be useful. We are not responsible for the content, availability or practices of external websites.

Technical guides

All technical guides are provided for informational purposes. We aim to make them accurate and test instructions where practical, but hardware, software and firmware can change.

You are responsible for deciding whether an instruction is appropriate for your own equipment and circumstances.

We are not responsible for data loss, hardware damage or other consequences resulting from changes you make to your own devices, except where liability cannot legally be excluded or limited.

Liability

To the extent permitted by law, we are not responsible for indirect, incidental or consequential losses arising from your use of the website or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or any consumer rights or remedies that cannot legally be waived.

Events outside our reasonable control

We are not responsible for delays caused by events outside our reasonable control, including carrier disruptions, customs delays, natural disasters, strikes, fulfilment-partner disruptions or significant service outages.

This does not affect any statutory rights you may have regarding delivery, cancellation or refunds.

Governing law

These Terms are governed by the laws of Mexico, except to the extent that mandatory consumer protection laws in your province or territory apply.

Nothing in these Terms limits rights or remedies that cannot legally be excluded or waived. Where applicable law gives you rights that conflict with these Terms, those rights prevail.
